1. Accepting these terms
By browsing, creating an account, or placing an order on portraits.com, you're agreeing to these Terms of Service (the “Terms”) and our Privacy Policy. If you don't agree, please don't use the service. You must be at least 18 years old — or 13+ with a parent's permission if they're paying — to place an order.
2. Your account
You can browse and generate previews without an account, but an account is required to place an order. You're responsible for keeping your login credentials secure and for everything that happens under your account. Tell us right away if you think someone else has gotten in.
3. Prompts, uploads, and content
The text prompts you write and the reference images you upload are “User Content.” You represent that you own or have permission to use any User Content you submit. You grant us a non-exclusive, worldwide, royalty-free license to process that User Content for the purpose of generating your artwork, fulfilling your order, and operating the service.
You agree not to submit User Content that:
- Depicts sexual content involving minors, or any content depicting minors in an unsafe or sexualized way.
- Depicts real, identifiable people without their consent — including celebrities, public figures, or private individuals.
- Uses third-party trademarks, logos, or branded characters without authorization.
- Promotes violence, hatred, or illegal activity.
- Infringes anyone else's copyright or right of publicity.
We reserve the right to refuse, delay, or cancel any order that violates these rules, at our discretion. We'll refund you in full if we do.
4. AI generation disclaimer
Our art is generated by AI models. Generation is probabilistic: the same prompt can produce different images, and the model may occasionally produce artifacts, unexpected elements, or results that don't perfectly match your description. That's why we show you a preview and let you regenerate as many times as you want before you pay.
We make no warranty that the generated image will match any specific expectation beyond the preview you approve at checkout. The preview is the deal: if the printed piece matches the preview and you're still not happy, we'll redo it for free under our returns policy.
5. Purchases, pricing, and taxes
Prices are shown in US dollars and are subject to change. Sales tax is added at checkout where required by law. Shipping fees, if any, are disclosed before you pay. We'll charge your payment method at the moment you place the order.
Returns, redos, and refunds are governed by our returns policy, which is incorporated by reference into these Terms.
6. Intellectual property
Your art is yours. For every image you purchase, portraits.com grants you a worldwide, royalty-free, perpetual license to use, display, reproduce, modify, and create derivative works from that image, for personal or commercial purposes. You own the output — full stop.
We retain ownership of the portraits.com platform: the website, the wizard, the preset styles, the code, the brand, and the underlying models. You may not copy, scrape, reverse-engineer, or clone the service. You may not use the portraits.com name, logo, or branding without our written permission.
7. Acceptable use
Don't use the service to break the law or to mess with other people. Specifically:
- No automated scraping, crawling, or bulk generation without our written permission.
- No attempting to bypass rate limits, safety filters, or authentication systems.
- No interfering with other customers' use of the service.
- No reselling generated images as stock or on other marketplaces as-is without adding substantial creative work of your own.
8. Warranty disclaimer
The service is provided “as is.” We don't warrant that it will be uninterrupted, error-free, or that it will meet any particular need or expectation beyond what's described on the site. To the maximum extent allowed by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the maximum extent allowed by law, portraits.com's total liability to you for any claim arising out of or relating to the service is limited to the amount you've paid us in the 12 months preceding the claim, or one hundred US dollars, whichever is greater. We are not liable for indirect, incidental, consequential, special, or exemplary damages (like lost profits, lost data, or business interruption), even if we've been advised that those damages might happen.
Some jurisdictions don't allow these limitations, so they may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold portraits.com harmless from any claim, demand, or liability (including reasonable attorneys' fees) arising out of User Content you submit, your misuse of the service, or your violation of these Terms. We reserve the right to assume the exclusive defense of any matter you're required to indemnify us for; you agree to cooperate with that defense.
11. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts sitting in Delaware, and you consent to personal jurisdiction there. If applicable law gives you different rights (for example, if you're a consumer in the EU), nothing here is meant to take those rights away.
12. Termination
You can stop using the service any time. We can suspend or terminate your access if you materially violate these Terms or if we're required to by law. Orders already in production at the time of termination will still be fulfilled (or refunded if we can't).
13. Changes to these Terms
We may update these Terms as the product evolves. Material changes trigger a notice — either an email to your account email or a banner at the top of the site — 30 days before they take effect. Continued use of the service after the effective date means you accept the new Terms.
